What does my son's fiancee stipulation to do to become court?
Her mother brought her (she's going to be 18 this October) and her sister (who is now 18) here in 2005 from Canada. Her mother is here on a work visa and she owns her home.
She and my son just have a baby in April. Please explain to me what she needs to do to become legitimate. And please no rude answers. I am very much against illegal immigration. Those of you who know me here understand. I am solitary concerned for my son and my Grandson's sake. Thanks for the help. It is appreciated =)

If your Son is a citizen ..
afterwards they marry and apply to adjust status
Marriage is the only credible way for her to become legal. If your son is a US citizen and they marry and she was inspected by an immigrstion officer when she enter the US, they can then concurrently file
an immigrant visa petition (form I-130) and application for adjustment

She desires to go back to her own country, before deportation take place and she faces a ban. Your son can petition her to come back on a fiance visa.

Marriage makes a difference when the person enter legally. She can adjust her status from the US. It is expensive. Life has a way of showing us that cruel judgment's and attitudes are not always reasonable. Congratulations again my friend.

The Criminal need to return to Mexico as you pointed out a billion times whats is good for the rest of the illegals is good plenty for your crew.He broke the law just by entering America. Did he use fake or stolen documents to go and get a job a in America, that rightfully belonged to a citizen ? How did someone from Mexico sneak into Canada ? The best you can do is tell them to return to Mexico and afterwards you can forward monthly allowances to him in Mexico.I suggest he return to Mexico and hire a lawyer like everybody else must do. He made his bed, immediately let him sleep in it. You could offer to by tickets to Mexico and recount them to wait it out.Illegal is just that illegal. If she entered next to a visa, then she is eligible to adjust status in the US only after getting married, see this guide here:

She would stipulation proof that her entry was legal to be able to adjust status.
Otherwise, if she doesn't own such proof or she didn't have a visa to enter, she would need to go through consular processing by applying for a fiance or spouse visa and after attending her visa interview in Canada, after which she would be given the visa to enter the US.
Her age is really important because normally, if someone present unlawfully left the US for their consular interview, they would receive a ban of 10 years without one able to enter again, and would need an I-601 waiver to cure that problem and get a visa. This is below INA § 212 a 9 B.
However, US immigration law does not count time under age 18 towards this law, and the first 180 days after age 18 result contained by no extra penalty.
