Legal problem Please advocate?!?
my best friend was convected in class 1 misdemeanor embezzlement "moral turpitude"underneath 200$ anyways she played guilty to one charge and the maximum sentence is12 months the judge only sentence her to 60 days in put inside all was suspended?! the lawyer who be hired by the court didn't tell as she is gonna have a problem in emigration. I contact the emigration attorney. and he said he cant do nothing because shes a Green card holder and she may get deported and took to jail. I contact the criminal advocate he told as she would not be deported because the crime was up to 12 months and the only one she did. but she wanted to competent to travel aboard. the lawyer told as that she may have a problem coming in if she travel. but they cant deport her. but the Q is why would they stop her from coming surrounded by. and if they DID what they gonna do to her?! her husband is US citizen so if she cant get deported why would they stop her from entering the US. then send her fund isnt that mean deported.?!!

im really sorry but it seems as moral turpitude does ban anyone from individual able to come into the USA , so if she travels out and then tries to comeback then it is terribly likely than she would be denied entry , which is not equal to being deported because she would not even be allowed inside in the first place . if i be her i would seek other alternatives and would not even dare leaving the USA . please ask her to check with a really well brought-up immigration lawyer .
If you commit a crime, you should expect to be punished. She should think that she got stale lucky that her punishment is not being allowed to travel outside the country. THe alternative is that she is not allowed to go anywhere because she is contained by Prison. AS to the other question, It is becasue we don't want criminals coming in to our country. THe law is plentifully more lenient for those who are already here because we tend to think of citizens commiting this crime. Sometimes the laws are not cohesive. They are sometimes made by two different groups of legislaters. If she did or does find banned/deported from the US. However you want to word it. Having a US citizen for a husband will not prevent this from happening. When you are on a green card you have certain responsibilities and knowing that if you break them, they can revoke your green card and remove you from the country. Why do you reason they would not deport her? just because she is married?
Sorry, but she she of thought of the consequences of her actions. There is a saying "If you can't do the time don't do the crime"
you do the crime you enjoy to do the time....and if it comes down to it and they decide to deport her...say au revoir She needs to jump back AND you need to quit asking the same damned query OVER AND OVER AGAIN!
