Does an immoral immigrant become officially recognized once he marry an American Citizen?

My brother-in-law, an illegal immigrant, is being held by Homeland Security for deportation to Mexico after a minor weapons infringement. He has been married to my sister for about 5 years. He have been in the U.S. for about 12 years. Is he not considered endorsed at this point?

It sounds like your brother-in-law is deportable for a couple reason. One would be that he's unlawfully present, and the other that he has a criminal history.

Take a look at section 237(a)(2)(C) and section 212(a)(6)(A) of the Immigration and Nationality Act and you'll see why he's locked up.
Think something like this now. If he was legal, would he be contained by detention? Would ICE bother to try to deport him if he was not deportable?

nah he is not concidered an american citizan until they get their green card and wait for five years to change their citizenship. But at the present time if you're illegal and married an american that does not make you american you are still illegal

He should be deported .He violated our law.If he commits a crime with a gun he is sure to run back to Mexico so not to be prosecuted.Probably back to his Original wife and kids .These folks live a double life.

It depends, you sister needs to speak to a attorney but he may not have to leave the country if he entered reasonably and if he did, she may have to file a I-601 wavier.
