Can an american citizen beside a criminal situation marry an not permitted immigrant?
Ok people, I need help beside this one. I would prefer an immigration lawyer or someone who experienced something similar to answer this, thank you. I have a mexican friend who has a boyfriend and he is american citizen but have a criminal background(been in jail, etc, but not for murderer or anything) and he wants to marry her so that she can be llegal and progress to shool and work. I told her that even though i know they are in love and all he may not be able to lend a hand her due to his criminal background, or so i was informed. Is this true? or can he marry her and actually petition for her legitimate status? thank you!

Yes, they can get married.
Their marriage will not get her legal in the United States. Assuming she entered the United States dishonestly (uninspected) she'll be forced to go back to Mexico and attempt to legally gain a visa from there.
He CAN sponsor her.
She's likely to be denied and banned from the United States for up to 10 years. At that point she'll inevitability to make an attempt to get a waiver of the ban. It's possible to obtain the waiver but she'll definitely need the assistance of an immigration attorney to do it.

He cannot sponsor her since he has a criminal background, and since he is marry her for the purpose of getting her legalized and to obtain benefits for her, the two of them are committing marriage fraud -- major felony beside long prison term plus $5000 fine. She needs to return to home country immediately. Nothing else will hang on to these two out of jail.
This sounds mean, but if two criminals want to marry, they can, but they won't put them contained by the same jail cell... They are both criminals and don't need any stinking law.

This is totally untrue- as long as the immigrant has no major criminal background - they don't seem to be to care what the citizen has done - I mean it wasn't close to drug smuggling or immigrant smuggling or terrorist plotting right? lol.. those types of international or immigration crimes might cause a problem but only because they might think the immigrant is involved as in good health..
Even somewhat major crimes like large amounts of drug possession and assualt and things should be ok.. They don't give the impression of being to care much what the citizen has done.

They will need something called an I-601 waiver if he was illegaly present more than 365 days after 1997. They will own to leave the country to apply.
