Illegal alien married to a citizen?
OK so a friend of mine has been living in the US criminally for 15 years (for safety purposes I have to say that I never know he was illegal) and he has been dating indistinguishable girl since they where in 8th grade. They granted to get married and the wife was OK about the reality the he was illegal and I guess that she is ok about the reality that jonathan(illegal alien) is illegal because they have been together for a fairly long time and if he wanted to just get papers he would own looked for a quicker way. So can he be deported after he gets married during the filing of papers for a Visa.
Answers:
no he can't. he's legally married. He shouldn't be. He could still be granted a citizenship.
He can not get deported but there is a haphazard that he may have to go back to his home country to complete the paperwork. I would consider discussion to an immigration lawyer. He can tell you what he thinks may come about (usually for free) and then he can help with the paperwork process (for a fee).
Just report to them Good Luck.
Oh and also. Does he have proof that he has been here for 15 years? (Bills or correspondence with his name and address on it with a postage recitation the date. Pictures with dates printed on them (they are sometimes on the back.) also written testimony from bosses, etc.
All of these things will help.
They also need these things as a couple. (Bills containing both of their names on them (Doctors or Dentist) and their address. This is to prove they hold been together and are a real couple.
Yes, he can and should be deported. An immoral alien marrying a US citizen does not convey citizenship. He was and still is illegal and subject to the regulation of the land.... deportation!
Yes, he can be deported if caught in the US illegally, period. He requests to go back to his country of origin and apply the proper instrument. If he is caught here, he stands a big chance of being barred for a long time or for time. Tell your friend to check into the legality of going back with him while they keep on for the legal way to enter.
He could still be put in to deportation proceedings at any time and would enjoy to request a stay based on his pending status.
That said, he may not be able to remain within the country anyway. If he entered without inspection (ie, illegally), then he would not be eligible to adjust his status inwardly the US and would be required to return to his country of birth to go through the process. This would make a stay difficult to obtain and he would probably be better rotten requesting voluntary departure.
Not only can he be deported. Marriage to a US citizen doesn't make him any smaller quantity of a criminal! But his wife can be charged with aiding, abetting and/or harboring an illegal alien punishable by 5 years federal prison and a $250,000 fine. Nice guy! Maybe he can knock her up formerly he leaves too!
Yes,
It does not matter if he is married to a citizen. In proclaim for him to process his papers, he must return to his country of citizenship and the citizen spouse must apply for his permanent residence (a K visa).
No. Probably not. He's legally married and can that`s why probably be granted a Visa without being deported.
I have a friend wife that just got deported subsidise to Canada. The laws has changed. It will cost him well over $1000.00 to even to find his wife over here. He really should file the paper for the Visa first.

Should criminal aliens own constitutional rights and protections when on American soil?
Why or why not? Only basic human rights. Other than that, I think not. If one comes here illegally, they should be treated dishonestly. And this is coming from an immigrant who came here LEGALLY. Yes.There is a big difference between fundamental constitutional rights and the...
