Can I sponsor my 17 years prehistoric nephew to immigrate to Canada? My parents hold his guardianship very soon.?

His father died 12 years ago and his mother got married half a year after that. Now my parents has his guardianship and I want to sponsor my parents to come to Canada. I wonder if I can sponsor my nephew as resourcefully? Do I need to separate the sponsorship for them? Should I get his guardianship first (My parents are more than 65 years old) or I should adopt him first? Many thanks!

According to: http://www.cic.gc.ca/english/immigrate/s...

"If you are a Canadian citizen or a fixed resident of Canada, you can sponsor your spouse, common-law partner, conjugal partner, dependent child (including adopted child) or other eligible relative (such as a parent or grandparent) to become a permanent resident."

And, according to: http://www.cic.gc.ca/english/immigrate/s...

"Who can be sponsored

You can sponsor:

* parents
* grandparents
* brothers or sisters, nephews or nieces, granddaughters or grandsons who are orphaned, under 18 years of age and not married or within a common-law relationship
* another relative of any age or relationship if none of the above relatives could be sponsored, and you have no other relatives who are Canadian citizens, persons registered as Indians under the Indian Act or everlasting residents and
* accompanying relatives of the above (for example, spouse, partner and dependent children).

Who cannot be sponsored

Other relatives, such as brothers and sisters over 18, or adult independent children cannot be sponsored. However, if they apply to immigrate under the Skilled Worker Class, they may get extra points for flexibility for having a relative in Canada."

You say, "...my parents have his guardianship...". You will have to provide documents to indicate that your parents have adopted him or otherwise hold legal custody of him. Immigration officials will not accept your word alone.

You will also enjoy to satisfy immigration officials that you will be able to cover any and adjectives costs of supporting your nephew. I'm a little concerned that your parents are older than 65 as this may result in immigration official asking a lot of questions about your parents' form. That does not mean we discriminate on the basis of age (we do not) but it may make things rather more difficult for your parents. Canada cannot accept immigrants who have robustness problems, for instance, so you will have to provide a fair amount of medical documentation attesting to their health.
