Is I 130 required if I voluntarily desert my PR status and apply again?

I may have to voluntarily abandon my PR status since I have be paroled in, after a long absence (The only other prospect is to go in front of a judge). I am in the USA and my husband is a USC. Can I afterwards directly file a I 485 for adjustment of status or will my husband also have to file a I 130 for the second time (the first time be when we got married and I got my green card)

A very apposite question for an attorney. However, if you were paroled in, I'm assuming below Humanitarian Parole, I can't see how you could adjust status without filing an I-130. Under normal circumstances, if you've be out of the US for over a year, you would have to requalify in order to adjust, and surrounded by order to do that, you would need a new petition.
I'm not comparatively sure on this question but please avoid abandoning your PR status if you can at all..
