Married beside a F1 Student Visa?

Hi,

I am studying in the United States on an F1 Student Visa. In March of this year, however, I married an American Citizen. Because I still have one more semester of college remaining I did not at once change my status. My question is, does anyone know which would be the best way for me to amendment it, not aquire citizenship, just gain my permanent residency?

Should I remain here with my husband and do it here? Or should I return to New Zealand at the appendage of the semester and go through the proceedings abroad?

Any other help or citation to a professional would be much appreciated.

It looks like you are eligible for adjustment of status (in other words, can directly apply for a Green Card/Permanent residency while you are here in the USA). Why to go to New Zealand and facade a long separation from your spouse, if you can lawfully obtain your Green Card while in the USA.

Unfortunately the current US Government seem to be in high "suspicion" mode ever since 9/11 and most immigration offices own been staffed with anti-immigrant conservatives. I would not doubt for a second that you would be highly scrutinize and you would probably be seen as someone who gets here on a Student Visa but with the intention of marry an American Citizen so you can stay longer.

If you apply from here in the states, do not be too surprised if you are denied permanent residency based solely on some elected representatives workers suspicion that the marriage is a sham just so you can stay surrounded by the USA. At the same time it is possible that everything would go smoothly...I do know from experience that things go much smoother when you avoid any and adjectives appearances of trying to scam the US government (even if that truly is not your intention).

Foreigners who come here on a work or student visa who wind up getting married while in the states on a transient visa have been subjected to harsher scrutiny.

My wife is from the Philippines and she had several friends who come here on work visa, got married to an American, then when they tried to adjust status the USCIS made them go rear legs to the Philippines and go through the process from there as proof that the relationship was legal....might be different though for people from NZ.

At the moment, you wouldn't be eligible for citizenship anyway. You would have to be a legal resident for 3 years before you could even apply. And, if you don't want to be a US citizen, you can be a decriminalized permanent resident for the rest of your life. No one is forced to become a citizen.

If you adjust status in the US, you can at lowest possible live together with your husband while the paperwork is being processed. It usually takes USCIS up to a year a moment ago to process and approve the petition. so, if he hasn't already filed, that means you would be in NZ reasonably a while waiting for the papers and the immigrant visa interview as once USCIS has approved, it still goes to the National Visa Center for more processing. That averages another 6 months. If you adjust status here, it will take at most minuscule as long, maybe longer to get everything done, but at least the 2 of you will be together, while you skulk. And you would be eligible for work authorization while you're waiting. But, if you do this, you can't leave the US until everything is finalized unless you apply for and get Advance Parole first. Check out uscis.gov for more informatino and downloadable forms, and take a upright look at the instruction sheet for the I-485 adjustment of status form while you're at it.
