Wht if my husband is an immigrant is contained by the process to attain his ssn and get arested and they want to deport him?

my husband was arrested on a gun charge and they are trying to deport him back to mexico. as his wife what can i do to help him not bring back deported.. he is in the process of becoming a legal residence and get a social collateral number and a license. he pays his taxes and owns a business

Wouldn't matter if he be legally here or not as for the second amendment goes, because most states have requirements on who can own them and what they must do to buy or possess one. In IL you must own a FOID card to even hold a gun

Why do you think that he shouldn't be deported? he is not even able to obey the law here long enough to get his citizenship. It's not like he jay walk, he was illegally in possession of a gun. citizen or not it is a pretty serious charge. I say aloud get rid of him.

You failed to specify the "gun charge," but it appears to be a major felony. Any immigrant, even one who enter legally and has a green card, can be deported for certain crimes, including crimes of sternness, sex crimes, child abuse/molestation, etc. In fact, for some crimes, it is mandatory that the person be deported and permanently disqualified from reentry.

If he entered illegally, that's a felony. If he has any history of other crimes, he's considered a multiple offender and probably a mandatory deport. So it is entirely possible that there is absolutely nil you can do. Morally, there is absolutely nothing you should do to aid and abet a criminal to evade the canon, such as any mandatory deport law which may apply here.

If you want to stay with this guy, he will have to apply for your immigration to his country of citizenship. Despite the predetermined info you give, it still appears that he cannot remain in the US.
You can't do anything. You or your husband are not above the regulation. He screwed himself by breaking the law. Why in the heck would we keep criminals here if we don't hold to?
It be illegal for him to have a gun, though, wasn't it? And isn't it a felony? If they are letting him off near deportation, are you sure you want to be fighting this?

You could try pushing it to the Supreme Court under the argument that the 2d amendment includes those not legally here, but I'm betting you won't win at the extremity of the road, frankly.

It isn't clear he wasn't legally here. Was he? There IS an argument that the second amendment protects those LEGALLY here. But it still would be expensive to fight.

If he be carrying a weapon without a permit, he has committed a felony, and while he be in the process of getting an SS Number, that has nothing to do near the felony offense. It is a guess.. he is going back to his home country.

1) Why have a gun on him? he must be doing' something' wrong. specifically a felony.
2) Sounds like he was here illegally. that's a federal regulation being' broken.

This whole situation is wrong. a good citizen legalized or not legal would not have these charges. he probably and should get deported.

Sorry. Your husband is pretty much screwed. If he was in the process of getting legal residence that routine that he is not a citizen. Anyone who is not a citizen, including permanent residents can be and will be deported if convicted of a gun felony. You can try to fight it but you will not win. There is very little shake room in this situation.
