SHe can move off and go back to Germany anytime but she needs him to sign to clutch her kids with her. She has no money because she does not have papers to work lawfully in the us. SInce she has children that are us Citizens and have lived inthe US officially married for over 10 years my question is does she still need his signature to get her green card?
Answers:
No, she can petition the US Government for a green card underneath the Violence Against Women Act (VAWA).
Under the Violence Against Women Act (VAWA) passed by Congress in 1994, the spouses and children of United States citizens or lawful permanent residents (LPR) may self-petition to pick up lawful permanent residency. The immigration provisions of VAWA allow certain battered immigrant to file for immigration relief without the abuser's assistance or wisdom, in order to seek sanctuary and independence from the abuser.

There is a type of visa for battered spouses to continue processing their green card applications. However, the numbers allowed and the conditions are very fixed. It does not appear that she meets those requirements. A lot of foreign women belatedly try to claim an abusive spouse because he refuses to verbs the application. Basically, the marriage is over but she does not want to leave as required. Hence, the strict proofs, etc. required.
Furthermore, being allowed to remain within the US provides no protection against the abuser. In fact, remaining keeps her at risk! She is safest if she returns to her own country since he is unlikely to follow her there. As long as she remains surrounded by the US, she remains at risk. Any battered spouse really needs to move away -- as far as possible!
She has no pending application and have been here illegally for years. She needs to progress home. Her kids have a right to German citizenship since she is a German citizen. If she gets them German passports, she can take them to Germany. Source(s): work next to battered spouses
