Someone next to an American born child wishes to buy a green card, how can she do that?
I recently met a really nice lady from India she came here around 13 years ago. She had been married to a really abusive man who almost kill her by not getting the insulin she needed to survive. So, her parents got her a visa and brought her here. About 4 months later, she had a baby(who is in a minute 13). She didn't go back and her visa expired a month later. She didn't run as she was afraid of her husband.
2 months later he divorced her. Her parents didn't sponsor her because they thought she didn't need it. But presently she is desperate to get a legal status here in the US. Is at hand anyway she can obtain a legal residency status here?
Any help would be greatly appreciated
Answers:
1. her parents can sponsor her
2. married a US citizen
3. wait till her baby 21 yrs and consequently sponsor her.
4. apply asyllum? I dont know if that wil work
If her parents are legal irretrievable residents or citizens, they could still file a petition for her. But either way, it will filch some time, years really. As noted the child could eventually file a petition for her, but not until the child turns 21. otherwise, unless she can find a US citizen husband, it's not really going to work. Even if the parents file a petition, she would remain illegal and subject to deportation until the petition is valid for use, if she's picked up. Asylum is not going to work so long after the certainty, and considering that her husband divorced her, it really doesn't appear likely that she'd be in danger from him at this point. You can other consult a good immgration attorney, but I'd doubt you'll hear anything better.
As long as she have proof ( like a stamped passport) that she entered the country ten years or more in former times, she should be eligible for lawful permanent residency. If she has be here that long and has a child who was born here she already HAS legal status, she only isn't documented yet. My advice would be this... many lawyer offer free consultations. If she finds one that handles immigration issues, she can check with them. I'm not sure where on earth you live, but contact your local immigration office and have them mail you the form I-485 ( you may be capable of print the form from the web; website is www.uscis.gov, and click on form I-485, "Application to Register Permanent Residence or Adjust Status"). The fee for submission of the form is a little over $1000, which is opening more than it was six years ago when my husband filed his. Depending on her financial status, this may be a difficult amount to come up with, but nearby may be a local organization that is willing to facilitate with some of the cost. Ask around, and best of luck to you. If you need any further info, or help padding out the forms, they may tell you you need an Immigration lawyer. In that bag, please contact me. I did all of our forms myself, and have assisted others I know with theirs. I would be beaming to help with hers (gratis).
if her parents are legal they can sponsor her.
her child cannot sponsor her until the child turns 21 years matured.
otherwise because she has been illegal for 13 years she may be required to check out of USA and apply from outside the USA.
These are US laws.
Yes and that is one of the problems we have here. The anchor kid . When the child is 18 they may petition for her. It really does not matter at this stage as she will not be deported . This is sad but true.
Resolved Questions:
Should crude born Americans grasp free money?
Should natural born Americans get free money? should the SSI system pay out to everyone that remunerated into it and make Immigrants pay more so the Natural born citizens that cannot find work or get relieve due to high immigration (like her in michigan) get free money while immigrant can work for nothing like they pay...
Having problem next to Husband+immigration?
Ok. I have a friend that she got married with US citizen a year ago. Everything be OK till the day he just freak out and left. She did dispatch some applications to immigration. This Guy also open a credit account without her knowing that. And immediately he is asking for money, or he will not sponsor her. This guy...
