my baby's dad had a baby by a non citizen and now she is gonna be deported but she have to kids that she had here in washington and one of them is my baby's dad's and if she gets deported does that anticipate the kids have to go or just her?? or does he own to fight for custody of his son so he wont have to leave? and is it true if she hurry up and gain married she wont have to leave the state?
Answers:
do you and your husband want this child?
does the birth certificate show the name of the father(and is it your husband?)
I don't believe citizens are deported, and if this child is a citizen your husband markedly can file for custody, most especially if he is the real father---might have to own a paternity test on this one
I be married for seven years to someone from another country. We even have a daughter. However that does not keep someone in the country. Only on TV does that save the day and keep someone here contained by the states. He would have to file and I-130 form for her if he married her and it could take years. My husband have to leave the country. We have a daughter he has never even see. She is allowed to stay because she is an American citizen. If at least one parent is American the child is also American even if born in another country (you just own to prove this when parents are not married). When parents are married no proof is needed. When a child is born in the United States they are given a U.S. birth certificate and a social security number.
She have the right to take her children with her especially if she feels that here is no one here to take care of her children. But they will enjoy the right to enter the United States whenever they choose as citizens of this country.
He can file papers with the courts, but as this deportation is scheduled to crop up within days. GOOD LUCK because bureaucracy is slow and this may take awhile.
If I were him I would contact a familial law attorney and an immigration attorney to see what can be done.
Yes, he can file for custody of the child and will probably have an advantage if he is a citizen because the mother is improper. And if the baby was born here, it is a citizen as well, so it does not own to be deported. Contact a lawyer.
marriage will not stop a deportation and should not. he needs to report and get custody, she has the right to take anchor babies near her, many choose not to. tell him not to marry her, she will still be deported and she can still take descendants with her. The only thing he can do is collide for custody and don't aid and abet any more illegals!
Sounds like a nice upstanding class of people, I reason all of you should be deported. We have enough trashy empire here already.
the poor child hes doomed to be second class citizen in the united states.i suggest adjectives of you self deport for the sake of the child and start rebuilding your lives where ever you belong.
What a mess your life is, already.
What's so wrong near your country of origin that you can't figure out this horrible mess back THERE?
