I received a "Driving beside a non-valid driver's license" ticket. What do you contemplate?
Yesterday I was stopped by a police officer while driving my car.
I bought the car in the order of two months ago when I got to Miami. I have been living surrounded by miami for two months now. Im from Venezuela. Im studying a master degree and my migratory status is student (F-1)
When the officer ask for my license I gave him my Venezuelan license, which I thought be good for 6 months (everything else was fine, registration, insurance, etc)....
The think is that, according to him, it be good only for 1 month. He gave a ticket for driving w/o a valid driver's license and agree to me go...I got stucked there and have to call a friend of mine to pick me up to take my car support home...
Later, I found out that this ticket is considered as a CRIMINAL VIOLATION.... WHAT?
A few hours after this incident I went to the driver's license office and got my FL Driver's License greatly easily... same day..
Here are my questions:
- what should I do??
- I be said that receiving that kind of tickets, even if you are not taken to the PD, it represent an arrest?.. so if someone ask if I have ever be arrested, I should say YES??
- Is it posible to go to the PD like, I dont know, tomorrow near my new DL and ask for the ticket to be discart??
- What are my chances?? worst case scenario?? Im thinking nearly hiring a lawyer to help me... will this ticket affect in anyway my verbs criminal record?? will this affect my migratory status?? will I have problems looking for a job after graduation?? renewing visas?? doesn`t matter what?

Get a lawyer, go to court, if as you read aloud everything else was fine the judge will most likely find you guilty of a sacrilege and fine you. This happens a lot as people moving from one state to another do not realize that you enjoy to register your car and get a license in the spanking new state and your old license and registration is void after a period of time (usually 30 days).

They might be able to dismiss the ticket since you got a license the next light of day. Go to the court and ask and if they don't then get a lawyer. I know society in Texas who have had this ticket and it doesn't show up on in attendance criminal record in texas its just a traffic vandalism.
Nothing is going to happen. Your going to court and show the judge your new license. You handle the problem. Your fine.
go to the DVM office and get a copy of the decree that you said that there is a period of 6 months to drive with the license of your country while you are student or anything visa you have, if you was wrong ask for an appointment with the mayor of the city that the cop give you the ticket and ask for a waiver,now if it was a state police go direct beside the governor,it is consider a crime depends the state law and if you already committed one the cop could put you under arrest,read the ticket carefully and later go to an organization of the community(sin fines de lucro),mostly they have attorneys or lawyer than can help you. call to the lawyer of"despierta america within univision channel"mr. lobo.he is honest and serious about it.
Simply stand before the Judge, explain what ensue and that you misunderstood the time duration. Show the Judge that you complied with the law by getting a valid license, by presenting it to him/her.
Arrested does not mean convicted. It manner you where stopped (arrested) for a possible violation. The officer did not drag you into court or jail so he did not come across to think it was a big deal. If the Judge throws out the luggage there is NO record for arrest, just ticketed. And cleared. This is NOT a criminal offense, This will not affect job. As far as visas and INS goes they have their own rules, so I do not wish to articulate how they view this, however I believe if it is dismissed they will not get involved at all.
According to the Florida DMV, you obligation to get a license within 30 days.
However, it also says this:
"The following folks may drive in Florida without having a Florida driver license if they hold a valid license from another state or country:
Any non-resident who is at least 16 years old.
Persons employed by the United States Government driving a United States Government motor vehicle on official business.
Any non-resident attending college within Florida."
Note the last one.
And yet, the website of the Florida Senate says this:
"It is a infringement of this section for any person whose driver's license has be expired for more than 4 months to operate a motor vehicle on the highways of this state."
It is not considered an arrest, it will not go on a criminal record. It is possible they will dismiss the ticket beside evidence of your new one.
