Sue the lawyer? Ah, litigation. The American dream.
Immigration lawyer is right, your family was never elgible to adjust status contained by the US under the Diversity Visa Lottery program since they were out of status. In fact, if your attorney in actuality attempted to process your DV claim, essentially he was just informing immigration that you were out of status and deportable and giving them your current location so they can pick you up. However, if that hasn't happen by now, it probably won't. Suing the lawyer won't bring back your DV status as once September 30 rolls around, your eligibility disappears completely. Suing the attorney may make you feel better but it will cost a lot of money and won't bring surrounded by any damages any time soon, even if you win. Of course, he may just decide that it would be so much easier for him if you pursue your law suit stern in your home country.
The problem is that even if you were preselected as a winner underneath DV 2009 Lottery, you are NOT eligible for green cards.
The reasons why you will be denied is because you came to USA as tourists, but overstayed and became "illicit immigrants". As illegal immigrants, your I-485 filed lower than DV Lottery will be denied.
A lawyer should have known better earlier allowing you even to submit any applications to USCIS (if she is really a lawyer, but not a unlicensed "notario" or "immigration specialist).
If you are under Immigration Court proceedings, winning contained by a DV lottery would not help, if you are presently in unlawful status. Let your parents talk to this "lawyer" or a physical lawyer, and see what is their situation and eligibility. Source(s): www.uscis.gov
