Can my friends boyfriend enter the USA legitimately?
So my friend is dating a Mexican who currently lives in Mexico. (She is an American). She wants to know if he can legally come to the USA to call in her if he has a felony in the USA. 4 years ago he was living up here properly and got caught selling cocaine. He had to do probation but was deported previously he got to finish. Can he legally come and visit her minus having to worry about going to lock away and what would they need to do to make sure this happens. He is also going to bring his two babyish boys up to visit too (2 & 3 yrs old)

He is in recent times using her to try to get back in the USA. He is fruitless news and she should ditch him before he makes her time a living hell. Or she will have to move to Mexico to live with him there. Same difference.
Sorry but a felon is banned from entering the US, if your friend is serious about maintain her relationship then she could move to Mexico; it doesn't matter that his probation period have not been completed prior to being deported - that is the up to the court and a prerogative of the USCIS to opt who and when a felon is to be deported.
Possession with intent to distribute is a serious felony and being here in the US as a legalized immigrant it is his responsibility to maintain good moral character and if he can't exhibit such behavior later he is certainly not welcome here.
We have adequate home grown criminals here and we don't need any more imports further muddying up the water...
No, he's most likely banned from the United States for the rest of his duration. At a minimum he can't even submit a waiver request for 10 years. If she wants to see this guy then she's going to have to progress there.
