No. There is NO WAY that a US court will give custody of a US born child to someone in the US illegally. They aren't giving a child to an prohibited alien who is subject to deportation at any time.

And the natural father would either have to a) afford up all rights to the child or b) have his parental rights terminated. While I cant speak to the likelihood of the former, the odds of the latter is slim unless there is a grievous, dangerous situation involved.

Even if he be Legal, he couldn't adopt a child unless the birth father gave away his parental rights to the child.
Double No because he is in the country illegally which vehicle he has broken a law and should not be playing father to a US citizen.
Just because a lawyer is working on getting his paperwork together doesn't progress his status. He is still illegal and as such may be charged and deported. If this happens and he returns to the country, he could be looking at felony and/or federal charges. Wait until the process has run it's course until that time you start talking about anything permanent next to this man.
Wait: how can the stepchild be a US citizen, but not the prospective adoptive parent? If you're my stepchild, doesn't that mean I'm married to your Dad, who must also be a citizen, and couldn't I become a citizen or at least a legal immigrant because I'm married to him? Confused.
