How credible is it that my friend get investigated by INS after marry a foreigner?

I have a friend who is thinking of marrying someone from Africa so that he can become a US citizen. As of right now I believe that the have an active green card. I am already aware that this is a felony and that, if discovered, he faces deportation and she faces put inside time and a large fine. Because of this I have already discouraged her from going through with it. Because I doubt she'll listen to me, my cross-question is about the likelihood of them getting caught. They do not plan to live together. They are just friends and hold absolutely no romantic ties to one another. I am looking for specific information about the investigation process, the likelihood of them human being investigated---and how soon after their marriage they can expect this process to begin. Helpful links would be appreciated.

Look the INS is markedly good at detecting fraud. They will let you know in a skinny minute if near is fraud involved that you will face prosecution and immediate deportation.
its not as easy as it looks... their times where married relations that have 3 kids. get investigated for messing up in their answers... taking to separtley rooms. you enjoy to have prove. like joint edge statements, life insurance, pics etc. Source(s): marrying someone to become legal. its wrong.

The investigation will start the minute they get married and apply for AOS.

If they infer they are smarter than the USCIS, then they're are in for a big surprise.
When will the process start? As soon as they file any paperwork for him to remain, base on marriage.

I will not coach you or anyone else on how to scam the system. However I will tell you that the immigrations officers can and do ask some exceptionally personal questions. They can interview the couple together, or split them up, and interview them separately, then compare their answers. A lot of people find caught in fake marriages going through this process. Personally I would not do it. But to be precise just me.

If they don't plan on living together the odds of them getting caught are VERY elevated.

USCIS (there is no longer any INS) will want to see things like a mortgage with both name on it or an apartment lease with both names on it, utility service in both name, joint car insurance, cars owned jointly, cohesive checking and saving accounts, joint credit cards, Federal & States Income Tax Returns filed mutually, etc...

USCIS will also ask for sworn affidavits from family and friends that they know this couple to be married and living together.

The first two years are probationary, the investigation begins at the start of the 3rd year of their marriage when he files to remove the probation on his green card.
