I-245 for C/1 D Visa?

My husband has this visa, is there anything that can be done for him to become legalized? He came within 1999 and is married to US citizen borned here. Any tips??

As a crewman (D visa), your husband is barred from adjusting status to permanent resident contained by the US unless he falls under the exceptions in INA section 245(i). Generally, that routine he needs to have a petition or a labor certification file for him dated before April 30, 2001. He may also need to show he was physically present within the US on Dec. 21, 2000. If he thinks he might qualify, he should speak with an immigration attorney who can look over his papers and confirm whether he can apply for the green card. He can apply for the immigrant visa from the consulate in his home country, but he is probably subject to the 10 year inn on returning once he leaves, so that is not a very attractive option.
