American citizen Mexican child, want to bring him over to California.?

My son was born in Mexico City I was living nearby till 4 months ago. I didn't know the legal procedure to bring him to the US with me so my mother is looking after him for me while I figure this out (He is 6 years old). I know very soon that I have to register him at the embassy in Mexico but Im wondering if I can do that in California...If so, where on earth? another question is... Can I cross the border just with his and my birth certificate. is that possible?
Answers:
No, you can not do this surrounded by CA. You need to go back to Mexico and folder a "consular report of birth abroad". The web site below should tell you what you need to do to register the child. After getting that straightened out you stipulation the fathers permission o remove the child from Mexico.
You could get the child a Mexican passport and skip getting him US citizenship if you want. Mexico does not allow dual citizenship so getting him US citizenship will find his Mexican citizenship revoked. He can however get Mexican nationality which is similar but with a few restrictions.
In any overnight case get him a passport and the fathers permission to leave your job the country with you.
Good Luck! Source(s): http://www.usembassy-mexico.gov/eng/eacs...
Were you a US citizen at the time of his birth? If so, why didn't you register his "birth to a US citizen abroad" at that time near the nearest US consulate and get his passport then? This must be done at the consulate in the country where on earth he was born. There are no US embassies or consulates within the US. You needed his "long form" birth certificate near both parents' names and citizenships listed. You also needed hospital records, toddler, passport photos, etc.

Now you will have to go through proving maternity, probably involving DNA test. You need info on the father and his citizenship. And it has to be done while you & child are in Mexico City, where on earth he was born.

If you were not a US citizen at the time of his birth, how did you become naturalized & did you include your child's info on your application?

No, you cannot cross the border near only your and his birth certificates! You both need proper passports. And to travel beside a minor child, you need the notarized and verifiable written permission of the father, or the father's death tag, or a court order of sole custody and the court's permission to remove the child from its jurisdication. Since the child was born surrounded by Mexico, you need to go to a Mexican court for this order.
As long as you are a US citizen then your son is a "naturalized" US citizen. I'm not sure why you would need to register anywhere surrounded by California.
Provided you were a citizen AT the time he was born, you must register him next to the embassy in mexico city so that they can give him a citizenship card. Then you need to receive him a US passport - which he must have in order to cross the border.

You enjoy no choice BUT to go back to Mexico city.

There is no US embassy or consulate in california - to register him near.

If you resided in the United States for 10 years with at least 5 years at the age of 14, your child is a US citizen. You would have need of to apply for a consular report of birth abroad and a U.S. Passport. If you show up at the airport or at the border without a US passport for your son, he will be denied entry. Contact the US embassy for the list of requirements. Its highly long and I think they require a DNA test if you are not married to the child's mother. Source(s): I did this in Mexico City for my child 7 years ago.
I think everyone needs a passport to cross the borders starting surrounded by 2009. You should check with INS. They can give you all the information you stipulation. Your son is not automatically a US citizen just because you are.
since you did not register your son to be an US citizen?
you cannot just cross the border with him, with single birth certificates, watch out,you will get arrested for kidnap.
how long did you live in Mexico ?
who is the father ? is he Mexican? because if he is? you will need permission from him to nick the son out. since he is Mexican firstly.
if you did not live in the US for a certain amount of time before your son be born? you have more problems on your hands .would you come back and explain yourself better? near details on father, how long you lived in Mexico, etc
