If you married someone that be surrounded by the US on a VISA, would they be allowed to stay or would they...?
...have to go back to their country?
Answers:
I think they'd hold to go back to their own country and then apply and be sponsored from at hand, married or not.
I'm not even sure if the marriage would be legal. Don't you have to be a US ciitizen to procure married in the US?
They would not have to return to their country unless their visa expired before a unknown visa was in place. I would consult with an immigration attorney. It is typically solely an adjustment of status matter, but it still takes time and requires various fees.
They enjoy to apply for an adjustment of status, to become a permanent legal resident. You would need to sponsor them as their spouse. It's no trouble-free task. ;)
no they will have to apply for adjustment of status and they will be allowed to stay.
It depends on the visa.
A "B" visa and attempting to stay is prima facie evidence of visa fraud.
On the other appendage if you had an F-1 visa you would be allowed to adjust status.
