Complicated situation in the region of indefinite move off to remain surrounded by UK, please try to assistance me?
Ok, I have been divorced for two years now and very soon found someone that I really love and we want to marry. He is currently living here on a student visa, which expires in two years.
We have two issues that need resolving past we take any steps, please answer both my questions, I'll be very indebted.
1. I have two children from my previous marriage, I am getting child benefite, housing benefit, working tax credits, child toll credits and child care costs through tax credits too. If I married the man I love, would I have to stop acceptance benefits, so it doesnt cause problems when applying for his indefinite leave to remain in uk?
2) Could he not win indefinite leave to remain in the uk through a permanent commission here, instead of applying as a spouse? Im asking this as that way, I may not have to stop receiving benefits, am I right? For your information, he come to uk as a student, he has just recently graduate and is looking for a good job now.
You might be thinking why I'm worried benefit clever, this is because even though I am working full time I do not earn enough but thankfully I'm receiving most of my housing benefit which almost covers my rent(lb700 for my house). If after marry him, I'll have to stop receiving all the benefits I'm panicky that I'll not be able to manage financially. I know that he'll be helping me financially too but he needs to capture a job first.
Please help me out on what will be best for us as we really love each other, and want to be together.

you need the money for the children and he hasnt get a job yet so you know you dont want to get within debt and to suffer.

If you get married, he would have to apply for a spouse visa to remain in the UK and for this to be granted you need to know how to prove that you can support the two of you without any recourse to public funds - so yes, I imagine it would affect your benefits in some channel, or his visa simply wouldn't be granted on the grounds of insufficient funds.
He cannot simply apply for ILR. There is a time period of two years first on a spouse visa before that can be applied for.

I am married to a non-EU citizen and aquiring a spouse visa is a difficult and expensive process - not simply a issue of getting married and everything being OK! The main criteria in command to qualify for the visa - right or wrongly - is whether or not you're financially secure. If you're unsure, get some advice from an immigration legal representative.
