Australian/American Dual Citizenship?

I'm getting married to an Australian this summer, gaining me dual citizenship in the US and Australia. We were both wondering- how would it be possible for HIM to draw from dual citizenship? And future children as well (this would make visit my family easier)

It all depends on where you will be living. If you intend to live contained by the USA, you would have to get him a Green Card which, after 5 years of residence in the USA would entitle him to apply for US citizenship. Although dual citizenship is technically prohibited in the USA, in practice many inhabitants practice it (including my wife, who is now a naturalized American). The US State Department has predictable the impossibility of denying it, so in practice it is allowed (although they ask you not to "flaunt it") despite some interesting constitutional issues which militate against it.

On the other hand, if you intend to live in Australia, you are out of luck. For him to become an American citizen he would hold to fulfull the residency requirement (in the USA) over 5 years which could, eventually, lead to US citizenship (My step daughter is doing this right now).

From what you say, it appears that Australian laws label it easy for you to gain Australian citizenship purely through marriage. US laws are not that forgiving. If you intend to live surrounded by Australia, the only way that your future children can be guaranteed US citizenship is if they are born surrounded by the USA. And, even that may change in the future. Otherwise, they will hold to apply as other potential immigrants do, when they are 18 or older.
Spouses of Australian citizens do not have an automatic right to lasting residence or Australian citizenship.

To be eligible for Australian citizenship, the spouse of an Australian citizen must be a permanent resident of Australia and must satisfy the requirements applicable to other adult applicants, including the residence requirement.

The US have similar laws that require 3 years of residence in the US without departing for more than 6 months at a time. That is after you get him a conditional green card then a regular green card. He will also need to appropriate an exam, pass a physical, background check, etc. Source(s): http://www.citizenship.gov.au/applying/s...
