Can I marry my girlfreind while she here on tourist visa?
If my girlfreind come here from another country on a tourist visa. Can I marry her while she is here and If I do will she still have to go back after her visa expire or can she stay?
Answers:
Are you a US Citizen? If so... Yes, you can marry. Yes, she can stay.
After the nuptials you file I-130, I-864 and G-325A.
She file I-485, I-131, I-765 and G-325A.
File them at the same time, indistinguishable envelope. The total fee will be $1,365.
When asked you must convince the person conducting the immigration interview that the marriage be not planned in advance... that it was on the spur of the moment.

It's fundamentally important that she NOT leave the United States until the I-131 has be processed and approved. If she leaves before then the paperwork will be void and she will not be allowed to come spinal column until the visa is processed in her own country.
Technically, marrying while on a tourist visa is immigration fraud. It can turn either way, and she may be required to leave and she may be allowed to stay. It will depend greatly on the information you can provide roughly speaking your relationship. It can be more costly than entering on a fiance' visa. It can result in her deportation and a bar from the US for a period of years.
Marriage = legal
staying after = prima facie evidence of visa fraud
you really need to apply for a K1 visa to get her to USA properly.
if you marry her on a tourist visa, then when it expires she will be ilegal and it will be very hard for you to petition for her because she is unofficial. Also she may be deported anyway because she overstayed the visitor visa.
If you marry her while she is here on a tourist visa that is fraud. You can go to penal complex and be fined up to $10,000. She will be deported and barred from entering the country or applying for a visa for 3-5 years. Very Very Bad idea. Source(s): My wife is from the Philippines. Went through the mill with INS.
No, you cannot marry her on a tourist visa. You know everybody would do indistinguishable but that is why they have fiance visas...do it in the court way!
Yak Rider, how can you convince anyone that a marriage was not planned? Why are you encouraging empire to lie to the authorities??
You will not resembling this answer. But, if you marry her while she is here on a tourist visa, she will still have to go back to her artistic country. The tourist visa specifically asks if you have a fiancee here in the United States. I'm sure she answered "no" or odds are she would not enjoy been issued the tourist visa. You can take pictures with her, attain the documentation prepared for you to apply for a fiancee visa for her. But, she will still have to return to her country. The immigration service will assume that she lied on her tourist visa application, if you marry her now. And they do not look politely on that when assessing your fiancee visa. Source(s): attorney
u could marry her. If she stays after her visa date afterwards she would be illegal immigrant.
Yes, but you need to start immigrant visa process as soon as you get married past her I-94 or visa expires to make her stay legal. Once she receives the Receipt Notice of I-485 Adjustment of Status, she is permissible status called 'pending AOS status' to wait until her decision of green card.
