Can an individual near relatives who are unsanctioned aliens contained by the US apply and seize a US visa?
Answers:
All applicants for a US visa must fill out the DS-156 form. On this form it does specifically ask about relatives in the US and their status; husband, wife, mother, father, sister and brother. If the relatives are included surrounded by this group, it will probably make things more difficult. Also, it would depend on what you mean by illegal; did they come on a visa and basically stay? If so, the Consulate will have this info in their database. If they simply swam across the Rio Grande, then this info is probably not within the database.
When someone stays illegally on a visa, they tend to screw things up for relatives in the future who are trying to call round the States.
if you want to get the visa sure, but you cannot claim them as relatives because they are not legal - unless the forms specifically ask this. for who? you or the illegals?
