Expired green card, immigration status?
I know nothing about immigration law, so here's some detail:
My father have been living and working in the US for over 20 years. His green card expired, I believe, around 10 years ago. He's (understandably) worried that if he leaves the country, he won't be let support in. From what I know, this is correct; however, he is afraid that if he tries to renew his green card, he will be deported. He told me that he has spoken to a lawyer roughly this (I'm not sure if it was an immigration lawyer) and the lawyer said the situation was complicated, so I'm not sure if there's more involved or if he spoke to the right type of legal representative. I'd really like to help him with this, as it would be nice to travel internationally beside my entire family.
If any of this matters, he pays taxes, his wife (my mom) became a citizen around 5 years ago and works contained by the US, and my brother and I were both born in this country.
So I guess my question is, what should he do contained by this situation?

Just wallet for a new Green card ..use form I-90
He needs to come clean and do what is right: win his crap together and try to become legal, even if it means being sent out of the country for awhile.
If he has a green card valid for 10 years (look at the issuance and expiration dates) and its expired, he should be able to renew it (USCIS application form I-90).
After renewing, he might be able to naturalize as his wife did.
Talk to a qualified immigration attorney (not a divorce advocate, or "notario", etc). He should certainly try to fix this problem before taking any trips abroad. Source(s): http://www.law-visa-usa.com - my immigration regulation office
