Illegal alien marry a green card holder - procedure!?
Hi, I have a friend who is a green card holder and is eligible for naturalization in less than two years (she have been in the US for a little more than 3 years). She is marry a person who overstayed his status and is considered an illegal alien. Can she still apply for naturalization in two years? And can her husband benefit from the two years they would own been married by the time she applies for her citizenship if/when they apply for adjustment of his status to permanent residency? In other words, will the INS consider the time spent together as a married couple in favor of her husband's legalization proceedings? Your answers and comments are greatly appreciated.
Answers:
I think she should obtain citizenship first, and later marry and file for the undocumented immigrant.
If your friend is not a citizen, her spouse will have to move back to his home country and wait for his spouse visa to come through. He cannot stay surrounded by the US to adjust his status as his wife is not a citizen. And if it looks like your friend is just marrying this personality so he can stay in the country, she can be prosecuted for marriage fraud and be deported, in postscript to being fined up to $250,000
Harboring an evil alien is a crime. It doesn't matter if the illegal alien is your spouse, its still against the law. Your friend could lose her green card and be deported. She might also do incarcerate time.
