What do I do after my sister file the I130 and Notice of Action be received. ?

Since then, I submitted a biographic data, I864 - Affidavit of Support, Police Records, Medical Records, work history, education, etc to the USCIS, which have been more than eight years ago. Can anyone tell me what to expect next?? Do I hold to file an Adjustment of Status, whilst I am here in the US, plus my son is a US citizen. Was my application cancelled?

If your sister filed an I-130 8 years ago for you, you hold another 3 years to wait before it's valid for use, unless your Filipino. In that case you enjoy another 14 years to wait. Until your petition is valid for use, or current, you can't file a proper adjustment of status request, and if you tried, you'd just be recitation immigration where to come pick you up, since if you don't have any other status, you're here illegally. There's no foundation to believe your petition was cancelled since they take a minimum of 11 years. However, if you don't have any current status surrounded by the US, you won't be able to use it even after it becomes current, unless you leave the US first and apply for your immigrant visa posterior home. If you're out of status, you can't adjust in the US on this sort of petition.
are you adjusting your status thru your sister or vise versa? if so you need to save track of the visa bulletin, you file for your adjustment of status once your priority date becomes current. Source(s): www.travel.visa.gov
