What happen if you become over 21 years after approval of I130 grip and when the crust is on impending contained by NVC?
Hi, My uncle filled an I-130 Immigrant petition for my mother and her family includes my father, me and my younger brother in November of 1999. The petition have been approved on Auguest 2005 and our priority date is Aug. 1999.
Me and my brother were under 21 years of age at the time of padding the petition and the time of approving the case. But now we are both over 21 years old.
We meditate that our priority date will become current this year or in the next year. The last approval mind on Aug. 2005 said that the original visa petition was sent to National Visa Center (NVC). Now I want to know, do we (me and my brother) still got a randomness to go for interview and get the visa with our parents since we are over 21 years at this time ? We are not married.
Please aid me to know what should we do when my mother's case priority date become current.

You may or may not fall under CSPA (child status protection act). Talk to a lawyer and do your own rummage through online to see if you still qualify. Go to Carl Shusterman's site, he recently sued USCIS for more clarification on CSPA. Source(s): www.dreamact.info/forum
Your case is Closed. A person wants to be 21 when his/her visa is approved after an interview at a U.S. Embassy. Source(s): Consular Officer
Resolved Questions:
New Year, will prohibited immigration develop?
Will the government step in and do something this year, with adjectives the bad press and what not, or do you think they will continue to drag their foot and do nothing about all the illegals contained by our country? Yes. There will bemore & more IIs . Obama's plans on giving 'em Amnesty. The government gets it's power...
