If she never had a visa and has been here since 2003. If she still attain married can she become legal with a lot of money through immigration lawyer. I've had a friend run through this. He had big problems because he was in the states at the moment. To bring married to a US citizen and become a citizen himself he was supposed to be in his native country previously the marriage. I hope she has better luck, at least the kids are citizens since they be born here.

She may be able to leave her kids in the US while doing this, but the parliament may need to insure that the home they will be left in is suitable.
