Domestically abused illegitimate woman, What can she do?
I'm writing a paper for my summer class college about illegal immigrant. Let's say a women was domestically abused in her country. She didn't enjoy any support (family wise) and she came to the USA to escape her abusive husband. She stayed over what her passport allowed. Is there any law that help her citizen wise? What is your opinion on a situation similar to this?
Please I need honest and INTELLEGENT answers. I'm really stuck on this one. My opinions seem to contradict respectively other and I can't find anything law wise.
BTW I am legal here. Im going to college and hold a job this is for a college paper.

The story is just not true ... An abused women may move a few hundred miles away from an abuser.... The belief in moving countries would be OK for someone in a superior financial state ..but I am sure this is not the case here.

Yes you can find laws that make a situation approaching this clear. The laws say DEPORTATION NOW for ALL illegal alien border criminal invaders. She would fit that criminal category.
Now you may be a loopy loony lying liberal who don't respect the law. That's a personal problem. Not a legal one. There is NO excuse for breaking the law.
No she would have to be either married to a citizen or legal permanent resident is the just way the GOV helps.
and let me ask you this: why is the USA the answer to her problem? why do so masses people think its up to America to always help yourself to up the unwanted/undesired/troubled citizens of other nations? she was a victim of her husband, not U.S. Taxpayers.....we owe her zilch
She could claim asylum here in the United States if she could demonstate that her duration or liberty would be in true jeopardy if she returned to her country. In such a case I would importantly recommend she consult and, if possible, retain an attorney since gaining asylum is not easy.
Had she be here in the United States, married a citizen or legal resident, and was abused by like, she could fall under the Violence Against Women Act, which protects certain classes of immigrant who are abused with the threat of deportation preventing them from seeking help.

I am also shocked that my answer is the only one so far to mention asylum. Goes to show how much family here know about immigration, yet they give answers on it constantly as if they know something. Some of them totally missed the point of the query, choosing instead ot make it political. Wow...
The only way she could benefit is if the abuser is a USC. I believe she can still get help out in other ways through charities etc in the US.
I think she should ask the Mexican government for help. Just because her Mexican husband abused her does not indicate that it is America is obligated to her.
regardless of what circumstance she face outside of combined state,that could not be ground for the uscis to adjust status.because of her illegal status and U.S.A have no juridical over what abuser does in different country.

Unfortunately she can not apply for asylum or refugee status. But she can married U.S.A citizen...only just a thought!
