Immigration answer if you know please?

my brother is here and his wife is US citizen, her petition for him is ready to adjust his green cart status, but the immigration law ask that he have to go back to Haiti to be able to process it cuz he does not own a visa, can he go Canada to process it without an I-94?

He needs to step back. My friend and her husband just went through like peas in a pod thing. The only way to legitimately do it is for him to run back , that takes out any potential future problems that may arise, such as getting a clothed job, buying a home, etc.. It can take a while, my friends hubby was gone for resembling 6 months. But it was worth it for them, just to have the undamaged thing behind them, and now he's completely legit.
As far as I am aware if he's here lawfully (entered the US legally and still has a legal status here (even if it is visitor)) he can (has to) stay here once the papers are file. I don't know how it works if he isn't here legally or if he want to go to Canada to process it. I would make an appointment near the uscis and ask around there. They can help, and it is usually a lot more clear next checking out websites. It might be tricky if he's here illegally, though, in that case the petitioner should probably dance alone. Good luck!
