my adopted child is 16 years old, i want to get a passport for him through the child citizenship exploit of 2001. My child entered the country with a tourist visa legally. Can he make a purchase of the U.S passport withouth having the I130 stamped on his passport ? he is not a u.s resident either. please tell me if he can purchase his passport without having the i130 stamped on his passport nor his permanent residence ??

I don't know if it can be done. It depends on a little things (including when he was adopted.) You will need to consult an immigration advocate who has some knowledge of international adoption laws.
In charge to derive citizenship, entry must be made as a lawful permanent resident. You're child is not a US citizen, yet. Don't put the pushcart before the horse, get him the green card first, before he's 18. A tourist visa is NOT an immigration visa. Get an immigration attorney! You hold committed visa fraud if you used a tourist visa to help him immigrate!
