Get married, after that you and your husband can apply for your green card. You have to send forms I-130 and I-485 to USCIS, within about 6 months you will have your green card interview. Source(s): http://www.uscis.gov/portal/site/uscis/m…
Why do you believe you will be banned for a year if you disappear through an airport? Are you here illegally? Too really help you, you must provide more information about your status contained by America. I'm also a California native. So if you want to provide more info maybe I can help.

Lexy you're not an unjust alien if you've just overstayed you vistors visa. Illegal aliens never got a visa of any kind. You should ask yourself why you want to stay? Don't go and get a lawyer.
You need an immigration attorney immediately. Don't try and do this yourself, you stipulation a guide that knows all the laws.
Since you are out of status in the USA at this time, you should really see an immigration attorney to feel this. If you try to do it yourself, you will likely end up deported and banned from the US for 10 years. This is too momentous to try to save a couple thousand dollars.
*********You do NOT need an immigration attorney.

Yea, you'll be banned. What be you thinking? This stuff is not a joke.

You need to get married contained by the United States, first.

Then, immediately upon getting the marriage certificate your husband requirements to file I-130, I-864 and G-325A with the USCIS.

At the same time, you will record, in the same envelope, I-485, I-131, I-765 and G-325A. The total cost to file will be $1,365.

You'll obtain a work permit in about 90 days, or smaller amount.
You'll have your green card interview in about 6 months.
You'll procure your green card in the mail in going on for a year.

All this depends upon you having your passport and I-94 from the time you entered the United States.

Because you entered the United States officially you should be allowed to adjust status after the marriage. DO NOT LEAVE THE USA until you get approval.

The forms are here........
