Green Card applied for, but divorcing. Still eligible?

A friend of mine is an immigrant who married an American and applied for a green card.
However, she recently caught her husband cheating on her, seperated from him, and wants a divorce, but is afraid to divorce because she has not recieved her green card even so. The status is this:

Application Type: CRI89, PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED

Current Status: Case received and pending.

The total wait time for approval is about 6 months. She have about 2 more months to go.
If she divorces her husband now, will that affect her probability of recieving approval for the green card?

You better believe it. Unless she can show abuse, very difficult, evidence including police reports etc., is required, cheating does not qualify.
She should verbalize to a lawyer off of the forum. It's simply not so easy to provide a complete answer here.

Generally, if separated but not divorced, she is not eligible to remove conditions. After divorce, she can folder by herself with a proof of a bona fide marriage, etc. Source(s): http://www.law-visa-usa.com - my immigration law department
Man, tell her to suck it up. If she has only get to wait 2 months for her unconditional green card, she should not blow it now. The end is so close contained by sight.
But to answer your question. If she did divorce him now, her application most more than predictable will be effected negatively in a huge way.

With a divorce, immediately, there's a chance her request will be denied and she'll be deported. It's not certain, but she will absolutely have need of the assistance of a good immigration attorney.
She has separated and moved out ...
If she don't move back immediately she is inert in the water
and will be going home .....

as she does not even have her conditional green card ..
the probability are nil ...

check with a lawyer post haste
