Answers:
if you are visiting legally,it finances that you have the visa so go to the closer office of the immigration bureau and ask beside your brother because those laws are changing from one day to other.
If your brother files a petition for you, you will have to leave the country until your case is processed. As you are not considered an direct relative, your case can take several years to be completed (at the moment, the processing time is over 14-15 years as I know). You cannot stay in the U.S. on a tourist visa. If you do so, you'll break the ruling and you will be considered an illegal immigrant.
Unfortunately, wait times for siblings applying for another can be extremely long, 10-15 years. You cannot stay contained by US while waiting for a visa number to be available to you. You would be deemed illegal and banned from US when that immigrant visa become available to you. If you stay 180 days or less in US after expiration of your entry, you will be barred for 3 years, 180 days or more, debarred for 10 years from entering US.
