Divorce since Interview?
What happens if a woman has been married two years and her interview is soon but she desires a divorce because she is not happy and the guy is crazy and wants to marry another man who she is in love beside? Can she divorce and not get deported marry the new guy and start the process over?
Answers:
> hasnt had the interview yet but will not even go
She oughta look at what it say in the interview letter: not going = abandoning application/petition and = subject to removal.
> what happen if she does not go? subject to removal?
> explain to me what happens?
They'll ship her a$$ back to somewhere she came from.
Is this for removal of conditional green card? Or first green card with conditions? I imagine this would really tilt some red flags at the USCIS. A green card based on marriage has to be lawful, and not for immigration purposes. If she's already wanting to get divorced, that will raise a few eyebrows. How did she get here within the first place? She may very well have to start over. She's indeed going to have a hard time at this point proving that her marriage is bona fide.
I'm currently going through this near my husband, and this kind of crap pisses me off. It's people close to this who abuse the system who make it so much harder for those who are legitimately married to get undying residency.
What kind of interview is it? If it is I-485 interview and she and/or her husband don't appear at the interview, her petition will be considered cast off and USCIS may start removing proceeding against her.
She can divorce and start the whole process over, but if USCIS will consider her first marriage as a sham, she may enjoy problems adjusting her status through her new marriage.
UPDATE: If she is a subject to removal, it process she may get deported. Removal = deportation.
It would void the spousal petition.
