Can I return with a green card ever?
My daughter was born in the US and has a passport, in consequence citizenship. I am on a non-immigrant visa but this may become an immigrant visa. If it does and I am here with immigrant status, can I apply for a green card?
Answers:
Immigrant status channel that you have green card status. In other words, a green card is only available to those who have be granted lawful permanent resident status, i.e. immigrant. So, yes, if you are in the U.S. as a legalized immigrant, you will have a green card to show that you are a permanent resident.
At the moment, you are a nonimmigrant who happens to enjoy a child born in the U.S. That means very little, if anything.
When your daughter is 21, she can petition for you, but you can't dally in the U.S. until her 21st birthday. If you become a permanent resident (immigrant) some other way, you'll bring back the green card at that point.
If your daughter is a minor the fact she's US born and have a passport is totally irrelevant at this time.
If your daughter is over 18 then she would know how to apply for a petition for a relative (for you).
How would your non-immigrant (tourist I guess) visa would become an immigrant visa? Depending on that if USCIS gives you (as you state) the immigrant visa, yes, you can receive it here in the US, but it would be depending on what kind of immigrant visa you'll receive.
it does depend on where your from. You could other apply for the lottery which closes in early december, 2008 (for the DV 2009 visas) as a back u. There are a no/of criterion as to whether or not you go and get a green card otherwise.
Your status is also going to be affected by the country you come from. We have agreements with some countries that fashion the process very quick and relatively painless. For other countries, there are edges on how many green cards will be issued to their citizens per year. Hopefully, you come from one of the countries that the US is very friendly with. (By the route, if it's a Latin American country, you are going to have your hands full!)
i think you should wait til it in reality become an immigrant visa
