General Skilled Migration Legislative Changes, Effective Date?
When the Department of Immigration changes the rules for skilled migration in Australia, like MODL (Migrant Occupations surrounded by Demand List)- the notices are usually published in the DIMIA website. I am anticipating some changes to the account which may affect my application as yet I do not have all the requirements I call for. Does any one know when these changes become effective? If say, they adapt on 15th February 2009, do the changes become effective immeadiately? Is there a timeframe given to comply - close to a certain date in which to comply? Please help.
Answers:
A Ministerial Directive be issued on 18/12/08 and became effective from 1/1/09. It has made massive change to the order in which visas are processed to the extent that MODL and SOL based applications are not mortal processed at at all at present unless the applications also have state government or employer sponsorship or the occupation are also on the new Critical Skills List (CSL). Occupations on the CSL are now being processed as of this week, but those for CSL occupation that were already in the queue from back within 2007 are being processed first. No application that already had a case officer have been affected, but all others be; many very badly.
It have been announced that a new MODL will be issued shortly even though it was not really due until May. You can expect it to become efficient from whenever it is published or at the least, within a couple of weeks of that date. Even then, the ministerial directive is still the driving force for determining processing priorities. See the following certainty sheet for a precis of the directive and links to the CSL and state government websites. See also the FAQs on the fact sheet for visa priorities:

Hint:
Even if your occupation isn't on the MODL, try to get state elected representatives or employer sponsorship which will mean that you will get fast processing. If the occupation isn't also on the CSL, even MODL processing have been put on the back burner until goodness know when.
