Who used I 512 after visa overstay?
i was wondering, if anybody ever used the travel document after a overstay?
i give you some details about my casing and hope somebody can help.
i came to the us already married on a waiver visa I 94W, which i overstayed. the congress man gave us that advocate after i found out that i was pregnant and my paperwork would never be finished by the time of my visa expiration. i filed for adjustment of status I 485 almost a year later. i get a ssn, license and work permit by now. my I 485 is still pending, but i get approved for the travel document. i read a million times that i shouldnt use it, bc it is not guaranteed that i gonna be allowed back in the us. uscis advised me to ring us bordecontrolro; and they granted me that shouldn'tnt have problems. i called 2 offices and get the same answer both times. but does anybody actually used it? thanks

Yes, just now a man was issued an I-512 Parole Letter, and upon his return to the U.S., he was held for a removal hearing base upon the unlawful presence he accrued prior to the time he filed for adjustment. The Litigation Dept. that has jurisdiction over the port of entry where on earth he entered found that the case was justifiably sufficient to pursue the case.
That is why the CIS warns people that they shouldn't travel on an I-512 if they own overstayed by more than 180 days within the past three years or if they had overstayed for more than a year inwardly the past 10 years.
Even if you succeed in being paroled final into the U.S., your I-485 cannot be approved because of the prior overstay unless you first are approved for a waiver of the grounds of inadmissibility resulting from the overstay.
Either way, you are going to screw yourself up by departing from the U.S. using an I-512 as your method of returning.
i wouldn't try. The law changes everyday. Just linger for your Green Card to be sure.
