Fiance Visa K1 USA will this work except how to work around the rules?
If I get a K1 Fiance visa to enter the USA and the person I marry is different to the one on the K! Fiance Visa form but is still a USA citizen. What happens subsequent, is it allowed? if it isn't what would be a great work around the rules in order to stay in USA? I am fundamentally flexible.
I have a flexible friend too.
Answers:
No, your plan also specified as Visa Fraud won't work and there is no way to work around the rules. K1 visa must marry the original petitioner inside 90 days of entering to US.
You maybe be flexible but not USCIS.
Because of the people who have be or planning to do "working around the rules", immigration officiers are looking really hard to find your true intention and that's why the immigration process is taking longer and longer.
Why are you trying to work around the rules. Usually that doesn't work. Why wouldn't you marry the person on the fiance visa? And if you deem you're not going to marry her, why not have the person you are really going to marry file for the fiance visa? Come over on the VWP and later marry whoever you want. This is "working around the rules" as long as you can prove you weren't actually intending to marry.
But seriously. Try and come over any legitimate way. Don't try to scam immigration. They're not stupid.
you will be asked to go the country and re apply for a K2 with the new person.
There is no shortcut.
getting caught will railing you from the USA for at least 10 yrs.
Immigration is tight right now, get a immigration attny(email me privately and I will offer you a good one that works cheap.)
Don't try it the way you mentioned.
It won't work. You're required to marry the person who petitioned for you, not any outdated U.S. citizen who happens to come along.
The court ruled on this scheme a couple decades ago because there be a time when this trick would have worked.
It isn't possible to enter as K-1 as the result of a petition from U.S. citizen A and marry U.S. citizen B and become a permanent resident from the marriage to citizen B.
Of course, there's the possible prosecution for attempting to gain an immigration benefit by fraud to verbs about too.
Why bother going through the hassle? Why not just get the character who you want to marry, to file the I-129F.
Listen, it isn't rocket science, what you are trying to do is circumvent the law and just trade name an easy situation difficult.
The person you want to marry is a U.S. citizen, why can she not file the form?
This complete "flexible friend" scenario is stepping into an area known as fraud; for which there are severe consequences.
Edit:
You are right, love is no crime, but visa and marriage ceremony fraud is.
In fact it carries a maximum sentence of 10 years, after which you will be deported and permanently expelled from entering the U.S. again.
Do it the right way, or not at all. Go over on holidays, have her come to the U.K. also: love grows and marriage ceremony happens at the right time.
Edit:
David, you certainly are one for the dramatics, even more so under your circumstances.
Firstly, the time frames and restrictions are here to ease immigration and prevent fraudulent people entering the country or perhaps you would prefer a free-reign approach to immigration where on earth terrorists, sex offenders and ordinary tourist can come and go as they please? I'll be sure to hold it against you the time a similar event close to 9/11 happens.
Secondly, no-one here is advising you to marry your friend and doing so is the riskiest move you can make. Furthermore, your friends are not friends if they are of a mind to risk you spending the next 10 years in prison. If they are what you call friends, next I don't want any.
Finally, decades is a little bit of an exaggeration. Get your girlfriend to file Form I-129F and you will have the K1 visa surrounded by hand in around 8-12 months. That is not a long time and with how busy you both will be preparing for the move and the interview; that time will fly.
Edit:
Please do not lounge. You were not eligible to apply for a work visa for your partner, unless of course you employed her.
You see in the U.K. a company must first apply for a work permission on the immigrant's behalf, since they cannot do so legally. Then once a work permit is approved, the person next applies for a work-permit holders visa.
All of this takes more than five days and as I said, unless you were her employer, you could not have done so.
As for mortal "efficient"- no immigration system is. The U.K. has problems with its boarders just resembling the U.S. The U.S. is a larger country with a bigger population and with more tourist, spouses, fiancees and everything entering each year than the U.K. does.
Things transport time. This is the way of the world. I am an attorney and I deal with this issues on a day by day basis. If you do not want to wait 7-12 months, like everyone else, next stay in the U.K. where it is more "efficient"
it is not allowed
why can your "real" fiance not database the papers for you?
and you know that you have only 90 days to marry after you arrive the usa.
really , people resembling you p!ss me of because they give all immigrants a fruitless reputation.
why can you not play by the rules like every good and grown up person would do ?
The K1 visa is only valid to enter the United States and marry the sponsor of the K1 visa within 90 days.
If you marry anyone else, you will be removed from the United States for Marriage Fraud. ANY fraud used to buy residence or Citizenship in the United States will result in termination or revocation of any benefit derived from the fraud. Citizenship can be revoked for fraud. Source(s): Fed LEO
After your marriage, your spouse "US citizen" have to file another form. So, if you end up marrying someone else it promising would invalidate your original visa.
